$3.35 Million Vaginal Mesh Verdict Against Johnson and Johnson

On February 25, 2013, a New Jersey jury held Johnson and Johnson accountable for the severe and significant injuries suffered by Linda Gross, a 47-year-old nurse from Watertown, South Dakota resulting from her use of the vaginal mesh implant made by Johnson and Johnson. Gross suffered from pelvic prolapse, a condition where the bladder, uterus, vagina, or bowel drops as muscles weaken due to childbirth, aging, or other factors. Because of her pelvic prolapse, this condition she was given a Gynecare Prolift made by Ethicon, a subsidiary of Johnson and Johnson.

But Ms. Gross, like thousands of other women who had the same procedure, suffered from mesh erosion, scar tissue inflammation and other complications leading to numerous subsequent surgeries including 18 operations to repair the damage. (The case is Gross v. Gynecare Inc., Superior Court of Atlantic County, New Jersey, Atl-L-6966-10.) The jury found that Johnson and Johnson failed to provide adequate warnings about the dangers of the mesh implant and misrepresented the product in its brochures.

In June 2012, Johnson and Johnson announced it stopped selling the device. In 2012, a Bakersfield, CA jury held C.R. Bard liable for injuries sustained by a woman from its vaginal mesh product.
